How the ninety-eight days work
The entitlement is ninety-eight days in total, of which sixty are paid at full remuneration. The employee can begin the leave before the expected date of delivery rather than being required to work until it, which matters for anyone with a difficult pregnancy or a long commute.
There is no minimum service period. An employee who joined recently has the same entitlement as one with ten years behind her.
The SSF maternity benefit
For employees enrolled in the Social Security Fund, the medical, health and maternity protection scheme is one of the four the contribution funds. That benefit is claimed from the fund and is separate from the employer's obligation to grant the leave.
In other words the leave is the employer's duty; part of the financial support may come from the fund. Companies sometimes assume the second replaces the first.
Practical points for HR
- Return-to-work date should be agreed in writing before the leave starts, and revisited if the delivery date moves.
- The role is protected. Maternity leave is not a gap to be filled permanently.
- Home leave continues to be relevant: an employee may want to extend the paid portion using accumulated home leave, and the policy should say whether that is allowed.
